Release from Liability I hereby acknowledge that I am voluntarily participating in a workshop conducted by Nye Simmons and Michele Sons, hereinafter referred to as "Workshop." I understand and acknowledge that engaging in outdoor photography entails various risks, including the loss of property, personal injury, and, in the worst case, death, whether from illness, accidents, events of nature, or other causes. Every reasonable effort will be taken to avoid situations that are risk prone, but it is your decision to abide by that guidance or not. Not all risks can be listed or predicted in advance, and none are excluded from this provision. I am fully informed or otherwise aware of, and fully assume, all risks to person and property in connection with my participation in the Workshop. Nye Simmons and Michele Sons do not take responsibility for non-refundable airline tickets and non-refundable cancellation fees from hotels or car rental agencies, or forfeiture of deposit. TRIP CANCELLATION INSURANCE IS STRONGLY ADVISED. I understand and agree that I am responsible for arranging my own health, accident and liability insurance, if so desired. I fully and forever release, waive and discharge, and covenant not to sue, Nye Simmons AND/OR Michele Sons from and for any and all demands, claims, actions, suits, damages, losses, liabilities, costs and expenses (including, but not limited to, court costs and attorney’s fees) from any cause whatsoever (including, but not limited to, travel delays, property damage and loss, bodily injuries sickness, disease and death) directly or indirectly arising in connection with my participation in the Workshop. Gross negligence, recklessness, or willful misconduct by Nye Simmons or Michele Sons including their agents, if any, is not covered in this waiver. If activities are conducted in a National Park, the following language and waiver apples: The undersigned further waives liability of the United States and acknowledges and agrees that the United States and its officers and employees are fully released from any liability for injuries, damages, or losses that the undersigned sustains as a result of or in connection with the undersigned’s participation in this activity. In the event that the workshop is canceled due to unforeseen and uncontrollable events affecting our ability to attend, a full refund of any monies paid will be made promptly. Trip cancellation insurance is recommended to cover any non refundable deposits or other costs incurred, as I/we do not accept responsibility for those costs. Covid 19: Vaccination is REQUIRED to reduce the risk of transmitting the virus to others in the group, as close proximity will be nearly impossible to avoid. Masking and other measures may be required in the event that a person shows signs of any respiratory illness, regardless of feeling "sick" during any time that we are in a closed room, automobile or other close proximity environment. FORCE MAJEURE Force Majeure shall mean a cause or event such as war or the threat of war, protests, riots, terrorist activity, civil strife, governmental acts, industrial disputes, labor strikes, injunctions, natural disasters, nuclear disaster, fire, wildfire, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including quarantine or other employee restrictions, or unfavorable or adverse weather conditions that are not reasonably foreseeable. Any delay or failure in the performance by Michele Sons and/or Nye Simmons shall be excused if and to the extent caused by the occurrence of a Force Majeure.
