Release from Liability
I hereby acknowledge that I am voluntarily participating in a workshop conducted by Nye Simmons, hereinafter referred to as "Workshop." I understand and acknowledge that engaging in outdoor photography entails various risks, including the loss of property, personal injury, and, in the worst case, death, whether from illness, accidents, events of nature, or other causes. Every reasonable effort will be taken to avoid situations that are risk prone, but it is your decision to abide by that guidance or not. Not all risks can be listed or predicted in advance, and none are excluded from this provision. I am fully informed or otherwise aware of, and fully assume, all risks to person and property in connection with my participation in the Workshop. Nye Simmons does not take responsibility for non-refundable airline tickets and non-refundable cancellation fees from hotels or car rental agencies.
I understand and agree that I am responsible for arranging my own health, accident and liability insurance, if so desired. I fully and forever release, waive and discharge, and covenant not to sue, Nye Simmons, from and for any and all demands, claims, actions, suits, damages, losses, liabilities, costs and expenses (including, but not limited to, court costs and attorney’s fees) from any cause whatsoever (including, but not limited to, travel delays, property damage and loss, bodily injuries sickness, disease and death) directly or indirectly arising in connection with my participation in the Workshop, whether or not foreseeable or contributed to by the negligent acts or omissions of Nye Simmons including his agents if any. By clicking this form, I agree to all terms and conditions listed above in this general liability waiver.
In the event that the workshop is canceled due to unforeseen and uncontrollable events affecting Nye Simmons's ability to attend, a full refund of any monies paid will be made promptly. Trip cancellation insurance is recommended to cover any non-refundable deposits or other costs incurred.
Covid 19: Vaccination is required for participation in this workshop. National Park Service requires adhering to masking whenever inside a Park facility. All participants must comply with those guidelines.
